You must be at least 16 years of age to use our services. By using our services, you represent that you meet this requirement. If you are using our services on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.
HGS Capital is an AI holding company that builds, operates, and maintains multiple AI-powered products, software applications, and technology platforms. Specific operational descriptions, performance specifications, and specialized terms of service may apply to individual products (e.g., ColdCraft or NYXAR AI). All such services are provided on a subscription, licensed, or pay-as-you-go basis, sometimes incorporating a limited free tier.
We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of services.
Access to free tiers or trials may be managed through your browser's local storage, session data, or email registration without formal account creation. Paid access to HGS Capital products requires a valid email address and an active subscription or billing profile managed securely through our designated third-party payment processors (such as Paddle).
You are responsible for maintaining the confidentiality of any credentials associated with your account. You must notify us immediately at strategic@hgsstrategic.com if you suspect unauthorised access to your account.
You agree to use our services only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
We reserve the right to suspend or terminate your access without notice if we determine, in our sole discretion, that you have violated these acceptable use terms.
Our intellectual property. The HGS Capital brand, website, and our suite of products (including ColdCraft and NYXAR AI) — including all design, code, copy, intellectual property, and system architecture — are the property of Haris Global Strategic Capital. You may not reproduce, duplicate, copy, sell, or exploit any portion of our services without our express written permission.
Your outputs. The outputs, messages, and content generated by HGS Capital products based on your inputs are yours. We do not claim ownership over the content you generate using our services. You are solely responsible for how you use those outputs.
Paid subscriptions and licenses are billed on a recurring basis through our authorized payment processors (including Paddle). By subscribing to any product, you authorize our processors to charge your payment method on a recurring basis until you cancel.
You may cancel your subscription at any time through your designated billing portal. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period you have paid for.
We reserve the right to change our pricing at any time. Price changes will be communicated in advance and will take effect at your next renewal date.
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our products will be uninterrupted, error-free, or that AI-generated outputs will be accurate, appropriate, or effective for your specific use case.
AI-generated content is probabilistic in nature. The quality and relevance of outputs depend heavily on the quality of your inputs. We make no guarantees about conversion rates, response rates, or business outcomes resulting from the use of our services.
To the fullest extent permitted by applicable law, Haris Global Strategic Capital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from your use of our services shall not exceed the total amount you paid to us in the three months preceding the claim.
Our services rely on third-party providers including Anthropic (AI processing), Paddle (payments), and Vercel (hosting). We are not responsible for the availability, accuracy, or conduct of these third-party services. Your use of these services is also governed by their respective terms and privacy policies.
We may terminate or suspend your access to our services at any time, with or without cause, with or without notice. Upon termination, your right to use the service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Karachi, Pakistan.
We reserve the right to update these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
